Charges Stand
If i stand on the border of the united states and shoot and kill someone in mexico, who charges me?
Mexico. United States law enforcement and the State Department would cooperate with Mexico and conduct an investigation on our side of the border, but Mexico would have jurisdiction because the act, homicide, occurred in Mexico. The firing of the gun did not cause homicide, but the bullet striking the person did, and since the bullet struck the person while the person was in Mexico, Mexico has jurisdiction.
