System Camera
System Camera
What are the laws of Pennsylvania on the establishment of a Home Security Camera / System (possibly hidden) in my backyard?
My neighbor has decided he wants to leave a security system in your backyard to record whether the neighbor hood will pet her. I wonder what are the laws in Pennsylvania under this system. Can any part of my yard to be captured? Signals are required to be published that has a security system recording? What what are my rights if my yard or house is being recorded?
It is illegal to record a conversation in Pennsylvania without the permission of all parties involved. See 18 Pa. Cons. Stat. ยง 5703. These laws are so strong that even a police officer was convicted of the crime, when he recorded a routine traffic stop in the AP. Consequently, a security camera that captures the sound can be illegal if it contains a conversation that is taking over the fence with another person, for example. In fact, it is a felony 3rd grade and allows you to collect civil damages of more than $ 1,500 or actual damages, which ever is greater, though not sure of the exact amount of money. Pennsylvania It also recognizes the tort of invasion of privacy. The question is whether an average person in the community is the act to be too intrusive. This will depend what your neighbor is able to record from the camera angle. If there is only a portion of your backyard, it may not be excessively intrusive. If the behavior camera records at home, this could be an unreasonable intrusion. The Constitution guarantees the right to privacy Pennsylvania more than the rest of the country. This because our Constitution is older than the federal document. Your best course of action would be to tell your neighbor that privacy laws prohibit Pennsylvania audio recordings without the consent of the person being recorded and that video recording is an excessive intrusion is a grievance that will make responsible party liable for damages. Your neighbor may legally register their property without notice, but the recording to others with or without notice may lead to legal problems.
